These Terms of Service ("Terms") govern your use of the Leaditio platform, including all lead purchasing services, lead submission forms, and related features. By registering as a buyer, submitting a lead, or otherwise accessing the platform, you agree to be bound by these Terms. Please read them carefully. If you do not agree, do not use the platform.

The following terms have the meanings set out below when used throughout this Agreement:

Service Description
Leaditio operates as a lead generation marketplace connecting Consumers who are actively seeking services with registered Buyers who provide those services. Our role is specifically limited to:
- Capturing Consumer intent through online forms and partner publisher networks across Gauteng
- Scoring and validating lead submissions using our proprietary AI-powered quality engine
- Delivering Qualified Leads to registered Buyers in real-time or on a scheduled basis
- Providing Buyers with a dashboard to manage lead flow, configure delivery preferences, and log replacement requests
Important: Leaditio is not a financial services provider, insurance intermediary, insurance broker, solar installation company, or any other service contractor. We do not provide regulated financial advice, and our services do not constitute financial services under the Financial Advisory and Intermediary Services Act (FAIS) or the Insurance Act. All service delivery is the sole responsibility of the registered Buyer.
Leaditio operates as a processor of personal information (as defined by POPIA) on behalf of Buyers, who act as responsible parties when using Consumer data for their own commercial purposes. Leaditio acts as a responsible party in respect of data collected directly through the Platform for scoring and matching purposes.
SECTION 03
Buyer Terms
3.1 Eligibility
To register as a Buyer, you must:
- Be a legal entity or registered sole trader operating in South Africa
- Hold a valid South African company or business registration (CIPC)
- Have a valid SARS tax number
- Operate in a service vertical supported by the Platform
- Agree to these Terms and the Leaditio Buyer Code of Conduct
Leaditio reserves the right to decline any buyer registration application at its sole discretion, including without limitation where the applicant operates in a prohibited industry or where verification cannot be completed satisfactorily.
3.2 Subscription Plans
Leaditio offers two monthly subscription plans billed via Paystack on a recurring basis:

3.3 Pay-Per-Lead Pricing
Buyers without an active subscription, or Buyers who have exhausted their monthly allocation, may purchase leads on a pay-per-lead basis at the following rates:
- Solar Energy leads: R160–R200 per lead
- Insurance leads: R120–R180 per lead
- Home Services leads: R80–R130 per lead
- Financial Services leads: R140–R200 per lead
Pricing may vary based on lead type (shared vs. exclusive), lead score, and current market demand. Prices are quoted inclusive of VAT at 15%.
3.4 Billing and Payment
- Subscription fees are billed on the anniversary of the subscription start date
- All payments are processed via Paystack. Leaditio does not store card details
- Lead quotas reset on each subscription anniversary date, not on a calendar-month basis
- Unused leads within a billing period do not roll over to the next period
- Failed payments may result in immediate suspension of lead delivery
3.5 Cancellation and Refund Policy
Subscription fees are non-refundable. In lieu of refunds, Leaditio operates a Lead Replacement Policy (see Section 4). Buyers may cancel their subscription at any time through the dashboard; the cancellation will take effect at the end of the current billing cycle. No partial refunds are provided for mid-cycle cancellations.
SECTION 04
Lead Quality & Replacement Policy
Leaditio is committed to delivering leads that meet our published quality standards. In the event a Hot Lead (score 70+) does not meet these standards, the following replacement policy applies:
4.1 Replacement Eligibility
A replacement request may be submitted only where:
- The lead has a score of 70 or above (Hot Lead classification)
- The Consumer's contact number is unreachable (rings unanswered or invalid) after a minimum of 3 documented contact attempts
- The 3 contact attempts were made within 24 hours of lead delivery
- The replacement request is logged via the Buyer dashboard within 48 hours of the original lead delivery timestamp
4.2 Replacement Limits
- A maximum of 10% of a Buyer's monthly lead allocation may be replaced in any given billing period
- Replacement leads are of the same vertical and comparable quality score as the original lead
- Replacement leads are subject to the same quality standards and scoring thresholds
- Replacement leads do not count toward the Buyer's monthly allocation
4.3 Non-Qualifying Scenarios
The following scenarios do not qualify for lead replacement:
- The Consumer was reached but declined to engage or was no longer interested
- The Buyer failed to contact the Consumer within the 24-hour window
- The lead had a quality score below 70 (Warm Lead)
- The Consumer's data was accurate but the Buyer's sales process did not result in conversion
- Replacement request submitted more than 48 hours after lead delivery
Note on Conversion: Leaditio makes no representations regarding conversion rates. Lead quality is assessed based on data completeness, intent signals, and contact validity — not on the ultimate outcome of the Buyer's sales engagement. Conversion rates depend on many factors within the Buyer's control.
SECTION 05
Consumer Terms
These terms apply to individuals who submit service enquiries via the Leaditio platform or any platform operated by Leaditio partner publishers.
- By submitting a lead form, the Consumer expressly consents to be contacted by up to 3 registered Buyers relevant to their stated service requirement
- For exclusive leads, the Consumer's information is shared with only 1 registered Buyer
- Contact may occur via phone call, SMS, WhatsApp, or email using the details provided on the form
- Consumers may request the deletion of their personal information at any time by sending a request to info@leaditio.com
- Deletion requests will be processed within 10 business days, subject to any legal retention obligations
- POPIA rights are preserved at all times in accordance with our Privacy Policy
- Consumers are not charged any fee for submitting an enquiry
- Consumers should only submit genuine service enquiries on their own behalf or with appropriate authorisation
SECTION 06
Prohibited Use
The following conduct is expressly prohibited and constitutes a material breach of these Terms, which may result in immediate account termination without refund:
- Reselling leads to third parties, data brokers, or any entity not listed as an approved user in your Buyer account
- Using leads for purposes other than direct outreach to sell the specific service the Consumer requested
- Adding Consumer data to generic marketing lists, CRM mass-blast campaigns, or telemarketing pools not related to the enquiry
- Systematic testing, scraping, or automated crawling of the Platform or its data feeds
- Submitting false, misleading, or inaccurate information during Buyer registration or lead management
- Using the Platform for any purpose that violates applicable South African law, including POPIA, the Consumer Protection Act, or the Electronic Communications and Transactions Act
- Reverse-engineering, decompiling, or attempting to extract source code or scoring algorithms from the Platform
- Creating multiple buyer accounts to circumvent subscription limits or allocation caps
- Submitting artificial or fraudulent Consumer enquiries to test the platform
SECTION 07
Intellectual Property
All intellectual property rights in and to the Leaditio platform, including the website, dashboard, scoring algorithms, data models, visual design, brand identity, content, and documentation, are owned by or licensed to Leaditio / Kgusiame Group and are protected under South African and international intellectual property law.
- Buyers retain full rights to their own business data, CRM records, and content they create independently using lead information
- Lead records delivered to Buyers are licensed for the sole purpose of direct service delivery to the Consumer named in that lead
- Lead data may not be aggregated, resold, or used for data brokerage purposes under any circumstances
- The Leaditio name, logo, and brand marks may not be used without prior written consent from Kgusiame Group
- Feedback or suggestions submitted to Leaditio may be used to improve the Platform without obligation or compensation
SECTION 08
Limitation of Liability
To the maximum extent permitted by applicable law:
- Leaditio's aggregate liability for any claims arising under or in connection with these Terms shall not exceed the total fees paid by the Buyer to Leaditio in the 30-day period immediately preceding the claim
- Leaditio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of profit, or loss of business opportunity
- Leaditio makes no warranty that Consumer contact details will remain valid, that Consumers will be responsive, or that any particular conversion rate will be achieved
- Leaditio is not liable for any outcomes resulting from the Buyer's sales process, pricing, service quality, or communication approach
- The accuracy of Consumer-submitted data is the Consumer's responsibility. Leaditio validates data against known patterns but cannot guarantee absolute accuracy
- Leaditio is not liable for any downtime, API interruptions, or data delivery delays caused by third-party infrastructure providers
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
SECTION 09
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms that cannot be resolved through good-faith negotiation shall be subject to the exclusive jurisdiction of the Gauteng High Court, Johannesburg.
Buyers and Leaditio agree to first attempt resolution through a 30-day mediation process before commencing formal legal proceedings. Mediators shall be appointed by mutual agreement or, failing that, by the Arbitration Foundation of South Africa (AFSA).
These Terms do not affect any statutory rights you may have as a consumer under the Consumer Protection Act 68 of 2008.
SECTION 10
Changes to Terms
Leaditio reserves the right to update or amend these Terms of Service at any time. In the event of material changes, we will provide at least 30 days' notice via email to the registered email address on your Buyer account before the changes take effect.
For minor or non-material changes (such as corrections or clarifications), we may update the Terms with shorter notice and will update the "Effective Date" at the top of this document.
Your continued use of the Platform after the notice period constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must cancel your subscription before the effective date of the changes.
